This website and the ARTrail™ experience are operated by CoMission Corp. Throughout the site, the terms “we”, “us” and “our” refer to CoMission Corp. CoMission Corp offers this website, including all information, tools, and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site, purchasing a Digital Art Block (DAB), or participating in the ARTrail™ experience, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

SECTION 1 - ELIGIBILITY AND MINOR SUPERVISION

  • Minimum Age: Users must be at least 13 years of age.
  • Mandatory Supervision: Use of the Services by any individual under the age of majority in their jurisdiction is strictly prohibited unless they are under the constant, active, and direct supervision of a parent or legal guardian.
  • Adult Responsibility: If you are a parent or guardian supervising a minor, you acknowledge full legal and financial responsibility for the minor's safety, conduct, and any damage to property or persons occurring during their use of the Services.

SECTION 2 - GENERAL CONDITIONS & COMMUNITY NOTIFICATIONS

We reserve the right to refuse Service to anyone for any reason at any time. Your content (not including credit card information) may be transferred unencrypted over various networks.

  • Community Notifications: Participation in CoMission community boards requires functional email notifications regarding interactions with your posts. As granular frequency settings are currently in development, you acknowledge that your option is to receive these functional notifications or to disable them entirely via your account settings or the unsubscribe link in the email footer.

SECTION 3 - ARTRAIL™: PHYSICAL CONDUCT & SAFE USE

THE ARTRAIL™ EXPERIENCE REQUIRES PHYSICAL MOVEMENT IN REAL-WORLD ENVIRONMENTS. BY USING THIS SERVICE, YOU AGREE TO:

  • Maintain Situational Awareness: Keep your eyes on your surroundings at all times. Do not focus on the AR viewer while in motion, in high-traffic areas, or on uneven terrain.
  • No Driving: Use of the Services while operating a motor vehicle, bicycle, or any other moving craft is strictly prohibited.
  • No Trespassing: You must respect private property. You agree to view art only from legally authorized public vantage points and to comply with all "No Trespassing" signs, local ordinances, and venue hours.
  • ASSUMPTION OF RISK: YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR PHYSICAL MOVEMENT IN THE REAL WORLD, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH.

SECTION 4 - DIGITAL ART BLOCKS (DABs) & MEMBERSHIPS

By purchasing a Digital Art Block (DAB), you agree that you are solely acquiring limited term license from the copyright holder.

  • No Ownership: You are not acquiring any ownership in that physical artwork, its related intellectual property, or copyright.
  • Refunds: Purchases of DABs are non-refundable unless otherwise required by law.
  • Access: CoMission does not guarantee that a specific physical AR installation (ARTrail™ location) will remain accessible or active indefinitely.

SECTION 5 - INTELLECTUAL PROPERTY & ARTIST PROTECTION

5.1 Ownership of Intellectual Property: You acknowledge that you are acquiring only a limited, non-exclusive license to a digital copy of the artwork. The original copyright holder (the Artist or their Assigns) retains all intellectual property rights, including moral rights and the exclusive right to reproduce, display, and distribute the artwork.

5.2 Permitted Personal Actions: For the period of your membership, we grant you a revocable, non-transferable license for the following personal uses:

  1. Collectors Certificate: Displaying digitally or printing one (1) copy for personal, non-commercial display.
  2. Home Streaming: Streaming the artwork to your personal digital screens, provided it is displayed on only one screen at a time.
  3. Social Media: Using ARTrail™ effects to create personal content for social media, provided no commercial gain is derived.

5.3 Prohibited Actions: You strictly agree NOT to engage in the following:

  • Reproduction: You may not reproduce, duplicate, or copy the artwork in any form beyond permitted personal displays.
  • Commercial Use: You may not use the artwork for marketing, advertising, or promoting any products or services.
  • Derivatives: You may not create derivative works, including alterations or modifications of the original artwork.
  • Public Display: You may not display the artwork publicly in a manner that allows the general public to access it without the consent of the copyright holder.

SECTION 6 - LIMITATION OF LIABILITY

IN NO CASE SHALL COMISSION CORP, OUR DIRECTORS, OR OUR LICENSORS (ARTISTS) BE LIABLE FOR:

  • Any physical injury or property damage resulting from your use of ARTrail™.
  • Any unauthorized access to private property by you.
  • Technical errors, GPS inaccuracies, or the removal of AR content from specific locations.
  • Any indirect, incidental, or consequential damages arising from your use of the Service.

SECTION 7 - PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to infringe upon our intellectual property or the rights of others; (d) to submit false or misleading information; or (e) to interfere with the security features of the Service.

SECTION 8 - GOVERNING LAW & JURISDICTION

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of Georgia, United States. Any disputes shall be resolved exclusively in the courts located in Atlanta, Georgia.
